SWORN TRANSLATION – Do you need to validate a title or file a patent in another language?

Below, we explain what documents require a sworn translation:

Any document that must be submitted to an official body will need a sworn translation.

Next, we will highlight the most common documents:

Certificates (birth, death, doctors, marriage, etc.), academic titles, court rulings, contracts, notarial deeds, patents, residence permits, divorces, adoptions, etc.

What is a sworn translation?

A sworn translation is one made by a sworn translator that certifies the document so that it can be used legally in exactly the same way as the original document.

The translator who performs a sworn translation must be recognised by an official body; in the case of Spain, by the Ministry of Foreign Affairs and Cooperation (MAEC).

A sworn translation must bear the signature of the sworn translator and the stamp that certifies its legal validity and certifies the accuracy of the translation.

Who is responsible for certifying translators?

In Spain, it is the MAEC itself who names the sworn translators. To do this, after obtaining a degree in Translation and Interpreting, translators have to undergo a rigorous procedure in which they take a language test in the combinations they offer.

Which agencies can request a sworn translation?

Usually this type of translation is requested in administrative and judicial processes where it is necessary to provide a statement or justification before the Public Administration.

How to legalise a document?

When proceeding with sworn translations, you must first ensure that your document is legal, that is, confirm that the signatures that appear in the document are original. To do this, they must carry the Apostille of The Hague, which legalises the document.

To obtain the Apostille of The Hague for a non-Spanish document, in Spain it is necessary to go to the consulate of the particular country, where they offer all the necessary information. In Spain, it is possible to legalise and apostille relevant documents in the Superior Court of Justice in Madrid.
